Can an immigrant marry a US citizen with a criminal record and still get a citizenship?




I am an immigrant and I am in love with a US citizen that has a criminal record. I want to marry him, and we would like to live in the US. Will his criminal record prevent me from receiving a Green Card/ US citizenship?

    You can marry, if you wish. I would think that his criminal record would certainly affect his ability to sponsor you. I know it will affect his earning potential.

    I’ve never understood the attraction of a convicted felon. Are you sure you don’t want to rethink this whole thing?

    you are free to marry him, and if he can support you, it should be ok. However if he cannot get a job (due to his prior record) then he cannot petition you.

    Eligibility
    In order for a relative to sponsor you to immigrate to the United States, they must meet the following criteria:

    They must be a citizen or lawful permanent resident of the U.S. and be able to provide documentation providing that status.

    They must prove that they can support you at 125% above the mandated poverty line, by filling out an Affidavit of Support
    The relatives which may be sponsored as an immigrant vary depending on whether the sponsor is a U.S. Citizen or a lawful permanent resident.

    If the sponsor is a U.S. Citizen, they may petition for the following foreign national relatives to immigrate to the U.S:
    Husband or wife
    Unmarried child under 21 years of age
    Unmarried son or daughter over 21
    Married son or daughter of any age
    Brother or sister, if the sponsor is at least 21 years old, or
    Parent, if the sponsor is at least 21 years old.

    In any case, the sponsor must be able to provide proof of the relationship.

    this PDF is the requirements of a sponsor. There is actually NOTHING that says he or she cannot have a conviction. So if he has a job and can support you at 125% of the poverty rate (whatever that is) then you should be ok.
