How big of a criminal offense is cutting down someones tree in a residental area?




Like, say me and my friend just got bored one day and decided to cut one of my neighbors tree down. If we got caught, how much trouble would we get in?

    thats funny! i was thinking of doing that too! lol. you would get arrested, of course. its damage to personal property.

    Criminal damage. Unlikely to be jailed, but you’d have to provide restitution. A fully grown tree is typically valued from $5,000 to $50,000, depending on the type and age of the tree. You’d be liable for that, and you’d have to pay it before you could get it off your record. Don’t look to get any kind of credit while you have that kind of judgement against you.

    You’d also get probation.

    For one thing, you would be trespassing on private property. Second, you would be guilty of vandalism and destruction of personal property other than your own. And I’m sure they could increase the penalties because it was all premeditated.

    I think you would be looking at some jail time.

    Depending on the amount of damage it could just be a misdemeanor or a felony. Trespassing, destruction of property, value of the loss etc.

    Yes it is criminal. Think about what the guys in prison do when they get bored. There’s a tree for you!!!

    Why would you want to cut down a tree? Do you know tree’s is what provides our earth with clean air?…dumb kids…

    Bear in mind I’m using common sense, acquired knowledge and then guessing. Putting aside any environmental laws you might break which would vary from state to state, county to county and town to town, it’s destruction of private property, the value to be determined by the cost of acquiring a new comparable tree and intangibles like the age of it and it’s value to the property. In that regard, it’s probably more likely a civil case, I believe. That aside, you risk the criminal misdemeanor charge of malicious mischief. Having said that, if there’s a really good reason for your wanting that tree removed, I think you should use the proper channels and have it removed legally. If you’re doing it because you’re bored, take up a musical instrument or something.

    If you’ve already done it, I suggest you ask a lawyer about this.

    Go on neighbors property. Trespassing.

    On the value of the tree. Over $1K and you have felony criminal mischief. If less, a misdemeanor. typically a decent sized tree will be in the $Ks to replace so most liekly a felony.

    On whether anyone is endangered when tree comes down. Reckless endangerment.

    If a child is present when the tree comes down. Child abuse (reckless/no injury).

    On why you cut down the tree or who was present. Could be harassment.

    Whether you take the wood away with you. If the value is over $1K. Felony Theft, if less then a misdemeanor.

    Add on the civil charges when your neighbor sues you to replace the tree.
