The recruiter can and will look the other way.
In the old days yeah. There was a time when the judge could give you a choice of going into the Army or going to jail. If your charges are being dropped and your record cleaned then the recruiter will be an asset. Otherwise he/she has no power to stop the judicial process. I’m surprised that you can enlist with your criminal background. Are you sure that you can? Have you spoken to a recruiter about this already because if not you should. From what I remember you don’t qualify for enlistment.
Yes, it is possible for a recruiter to appear in court with you. It is up to the recruiter to make that decision.
If a judge is willing he may dismiss the felony or put it down to a misdemeanor to allow you to join the service. A deferrment of prosecution will not work because there will still be a chance the charge will be prosecuted as a felony.
It would be helpful if you discuss this with your recruiter. It is common for recruiters to write to the prosecutor and/or judge informing them of your intention to enlist. If possible, they should request the felony be dismissed to allow that to happen.
If you have already signed papers be sure your public defender is aware of that and has a copy to back up your words.
Good luck in court and in the service.
