Is it legal to spread someones criminal background?




My husbands ex-boss wrote an email disclaiming his criminal background what he wrote was true. His boss sent it to all of my husbands potential customers. I wanna know if this is legal and if we can sue him for that. We have a copy of the email. It is very negative against my husband there is also some untrue things in the email. Please let me know.

    It would be libel. Call a lawyer.

    You husband should consult an attorney as soon as possible.

    A person who makes false statements about another person and who damages that person’s reputation may be liable for the damages. Your attorney will explain slander and libel to you.

    Spreading true stories, no matter how harmful, is almost always not actionable.

    The best defense for libel is the truth. If what he is spreading is public record, it might be difficult. BUT, if what he is spreading is malicious, you might have a case. Get a lawyer, get a restraining order. In order to collect in a libel case, you have to show damages. This means that he will have to show that customers did not buy from him due to this information and they will have to testify to this. I would scare his ex-boss with a letter from an attorney.
